Los Alamos Man Charged With 27 Counts Related To Abuse Of A Child Under 13 Years Of Age

A warrant was issued Jan. 20 for Michael A. Novak, 60, of Los Alamos, wanted for rape of a child under 13, according to court documents obtained by the Los Alamos Daily Post.

The alleged crimes occurred Jan. 17-18. Los Alamos police arrested Novak in the afternoon of Jan. 20 at his apartment on Yucca Street. He was later released from jail after the District Attorney declined to request he remain in custody pending trial.

Novak is charged with 27 counts including:

  • 12 counts of criminal sexual penetration (child under 13) (1st Degree);
  • 12 counts of criminal sexual penetration (child under 13) (2nd Degree);
  • 2 counts of battery; and
  • 1 count of intimidation of a witness (Threats – False Testimony).

Court documents state that Novak was babysitting the child over the Jan. 17-18 weekend. The child reportedly told its mother what Novak had done. The child was taken to the hospital where tests conducted on the child revealed injuries consistent with rape.

Novak’s first court appearance was held Jan. 21 when he went before Los Alamos Magistrate Judge Pat Casados. His case was transferred Jan. 27 to District Court.

A status hearing on this case is scheduled for Feb. 26.
