Los Alamos Board Of Appeals Continues Deliberation On Sirphey LLC Case To Friday

The Los Alamos Board of Appeals voted this afternoon to continue its deliberation of the Sirphey LLC case until 2:30 p.m. Friday, Jan. 21. Jain brought a complaint against Los Alamos County Council and Building Official Michael Arellano after the new business space he was renovating in Mari Mac was red tagged. After Today Priestley presented an overview of the various hearings and actions that had taken place in the case to date, he adjourned the meeting and the Appeals Board entered into closed session to deliberate and return with their final decision. The issue is that the Board of Appeals and County Council thought the verbal decision and minutes from the meeting were sufficient. However, the board is required by law to issue a written decision outlining with particularity the findings of facts and conclusions of law, which support its decision. In a court document dated Dec. 1, 2021, District Court Judge Lidyard ruled that a final written decision regarding Appellant’s appeal of the stop-work order had not been issued.
