Public Notice: Transfer of 679 acre-feet per (afa) of water to be used for municipal, industrial and other uses in LANL and Groundwater Remediation

PUBLIC NOTICE

Notice is hereby given that on January 24, 2019, The U.S. Department of Energy, Environmental Management, Los Alamos Field Office, Kirk D. Lachman & Cheryl Rodriguez, 1900 Diamond Drive, MS-M984, Los Alamos, NM 87544, and the Incorporated County of Los Alamos, Department of Public Utilities, 1000 Central Avenue, Los Alamos, NM 87544 filed with the State Engineer, an Application for Permit to Change Purpose of Use and Permit for Additional Groundwater Points of Diversion within the Upper Rio Grande River Basin, OSE File No. RG-00485 et al.

The applicants seek permit to transfer 679 acre-feet per annum (afa) of water to be used for municipal, industrial and other uses in Los Alamos National Laboratory and Groundwater Remediation. The applicants are requesting 1) to change the purpose of use for groundwater to add the purpose of groundwater remediation, and 2) to add groundwater points of diversion (PODs) to access existing permitted water rights in support of the Interim Measure for Chromium Plume Control and Chromium PlumeCenter Characterization for control and further characterization of hexavalent chromium contaminated groundwater beneath the Los Alamos National Laboratory (LANL). The applicants do not intend to increase diversion amounts over the permitted amount. The applicants intend to seek approval of a return flow credit plan at a later date. Impacts to the Rio Grande will be offset in an amount and manner approved by the State Engineer.

The permitted 679 afa are currently designated for municipal, industrial, and other uses at the Los Alamos National Laboratory. The move-from groundwater PODs are located on land owned by the applicants and Bandelier National Monument. The move-from PODs are identified by the following X and Y values in NM State Plane Coordinate System, UTM (NAD83) Feet:

The place of use will remain the same and is identified as the Los Alamos County Service Area. Maps of the place of use may be reviewed at the Office of the State Engineer, Santa Fe District 6 Office, upon request.

The move-to purpose of use is municipal, industrial and other uses in Los Alamos National Laboratory and groundwater remediation. The additional points of diversion for the Groundwater Remediation are located at LANL, Mortandad and Sandia Canyons, in Technical Areas 05, 53 and 72. The move-to groundwater points of diversion are located on lands owned by the U.S. Department of Energy, identified by the following X and Y values in the NM State Plane Coordinate System, Central Zone, UTM (NAD83) Feet:

Any person, firm or corporation or other entity having standing to file objections or protests shall do so in writing (legible, signed, and include the writer’s complete name and mailing address). The objection to the approval of the application must be based on: (1) Impairment; if impairment you must specifically identify your water rights; and/ or (2) Public welfare/conservation of water; if public welfare or conservation of water within the state of New Mexico, you must show you will be substantially affected. The written protest must be filed, in triplicate, with Tom Blaine, P.E., State Engineer, Bataan Memorial Building, Room 102, P.O. Box 25102, Santa Fe, NM 87504, within ten (10) days after the date of last publication of this notice. Facsimiles (fax) will be accepted as a valid protest as long as the hard copy is sent within 24-hours of the facsimile. Mailing postmark will be used to validate the 24-hour period. Protest can be faxed to Office of the State Engineer, 505-827-6682. If no valid protest or objection is filed, the State Engineer will evaluate the application in accordance with Sections 72-2-16, 72-5-6, and 72-12-3.
