The State of New Mexico’s Environment Department (NMED) will host a community engagement meeting
on September 26, 2024 from 5:30 p.m. to 7:30 p.m. to share the modifications made to the Los Alamos
National Laboratory 2016 Compliance Order on Consent (CO). The meeting will be held at the New Mexico
Environment Department Harold Runnels Building Auditorium, 1190 St. Francis Drive, Santa Fe, NM 87505
and will also be available via Microsoft Teams.

The CO is a settlement agreement between NMED and the U.S. Department of Energy (DOE) that was issued in 2016. The investigation and remediation of contamination from legacy waste at LANL is conducted under the CO. The CO both guides and governs the ongoing cleanup of legacy waste at LANL through a campaign-based approach and the annual planning process.

NMED found the annual planning proposal in fiscal year (FY) 2021 to be deficient and initiated a dispute resolution to satisfy the concerns. After unsuccessful negotiations with DOE in dispute resolution, NMED utilized the statutory authority to enforce the CO by seeking judicial relief and penalties in a civil complaint filed against DOE in February 2021. NMED and DOE have participated in court ordered negotiations to revise the CO and provide resolution to NMED’s civil complaint. Revisions to the CO provide much needed updates on public involvement, a more effective dispute resolution procedure, and expanded enforceability of clean-up deadlines with a new five-year schedule. Modifications to the CO have been
finalized and NMED is now sharing the revisions by hosting this community engagement meeting. The
revised CO is available on the NMED website under the Compliance Order on Consent at: https://www.env.nm.gov/hazardous-waste/lanl/.
