Hearing Date Set In UnQuarked Stop Work Order Case

A stop work order posted Nov. 22, 2019 at UnQuarked, 813 Central Ave., has been contested by owner/CEO Prashant Jain of Sirphey, LLC, which operates UnQuarked.

Los Alamos County Board of Appeals met Friday to address the matter and approve procedures for a full hearing set for 8 a.m. March 30 in Council Chambers.

“This is to get us to next step in the process,” Council Chair Sara Scott said.

Scott is a member of the Board of Appeals together with County Manager Harry Burgess and Planning and Zoning Chair Terry Priestley.

Jain and Sirphey Communications Director Cortni Nucklos and Los Alamos County Assistant Attorneys Kevin Powers and Katie Thwaites along with County Building Inspector Michael Arellano were at the meeting.

County Attorney Alvin Leaphart participated in the meeting as legal advisor to the Board.

Regarding the case, Sirphey, LLC Appellant v Michael Arellano in His Official Capacity for Los Alamos County, Appellee, Thwaites submitted a motion that the appeal be dismissed. She said Sirphey, LLC, has no standing to bring an appeal because the company has never proven it had the permission of actual owner of the property to apply for a building permit as required by County Ordinance. She also recommended the board tour the property.

The Board provided time for Jain to file a response to the motion; the deadline for his response, as well as all other briefs in the case is March 6. The Board indicated that it would take the motion under advisement, and rule on it at the March 30 hearing.
