After Nearly 5 Hours Council Recesses On Sirphey Appeal

COUNTY News:

After almost five hours of oral arguments, periods of questions and answers and two executive sessions, no final decisions were made regarding the Sirphey, LLC appeal to Los Alamos County Council on two orders made in January by the Board of Appeals.

Los Alamos County Council held a special session Tuesday night to discuss the appeal but ultimately recessed and will continue the meeting at 6 p.m. today.

The two orders being discussed are:

  • Board of Appeal’s decision regarding the stop work order at 813 Central Ave. with findings of fact and conclusions of law; and
  • Order on appellant’s motion to re-open the Board of Appeals proceeding for taking new evidence and reconstitute the Board of Appeals.

In attendance were Councilors David Reagor, David Izraelevitz and Melanee Hand as well as Vice Chair Denise Derkacs. Councilor Sara Scott and Chair Randall Ryti recused themselves.

Sirphey LLC is being represented by Los Alamos attorney Phil Dabney while Associate County Attorney Kevin Powers spoke for the County.

Santa Fe Attorney Tony Ortiz is serving as facilitator.
