A 29-year-old Hernandez man is back in jail after allegedly violating the terms of his probation under two First Judicial Court cases after he allegedly made abusive contact with a victim.

Adrian Joshua Trujillo went to the victim’s place of work Sept. 16 in Pojoaque where he allegedly made contact with her and after she told him he needed to work on his anger management issues, he allegedly struck her left eye with his closed fist.

Trujillo was originally charged in 2015 with false imprisonment, aggravated battery against a household member, assault with intent to commit a felony against a household member, and battery against a household member. In 2016 he was charged with an additional two charges of battery against a household member. The victim in both cases was the woman he allegedly struck during the Sept. 16 incident.

Under the terms of a plea agreement approved by Judge Mary Marlow Sommer May 2016, all the above charges were dismissed except for two counts of battery and Trujillo received two consecutive suspended sentences of 364 days and was placed on 364 days of supervised probation. Under the terms of his probation he was ordered to have no contact with the victim except for court hearings and child custody visits approved by a family court.

Trujillo also was ordered not to leave Rio Arriba County without permission. Additionally, Los Alamos Magistrate Court charges of false imprisonment, interference with communications and battery against a household member were dismissed.

Adult Parole and Probation officials have asked the court that if probable cause is found that Trujillo violated his probation, that he serve the remainder of his term in custody.

“He seemed to have adjusted to probation with only a few preliminary violations such as status and alcohol use. (He) continues to sabotage himself with negative behavior and total disregard for other peoples’ safety indicating that he is not a good candidate for supervised probation,” an APP official said in court documents.

A hearing on the probation violation is set for Nov. 2.
