First Judicial District Attorney Marco P. Serna’s office has announced the findings of the Officer Involved Shooting Review Committee’s evaluation of the investigation of the shooting death of Andrew James Lucero by Santa Fe Police Ofc. Leonardo Guzman. 

In a letter to Serna, Fourth Judicial District Attorney Richard Flores said the committee unanimously agreed that Ofc. Guzman acted in the lawful discharge of his duties and that the killing of Lucero was a justifiable homicide by a police officer. 

“As such, the committee recommends that no criminal charges be filed,” the letter said. 

Before reaching its unanimous decision, the committee reviewed all police reports, audios of statements, photos taken during the investigation, the medical examiner’s report as well as statements made by Santa Fe Police Ofc. Alexis Carlos and New Mexico State Police Agent Jeremy Stricklin, both of whom were at the scene at the time of the shooting.  

Video of the scene, including when Ofc. Guzman discharged his weapon also was reviewed. 

The committee, which includes five district attorneys from around the state, was created by Serna earlier this year to create “the highest level of fairness and accuracy” when police shootings are reviewed.
