NMSP Probes OIS Involving United States Marshals Service

CLOVIS — On June 16, 2025, the New Mexico State Police Investigations Bureau was requested to investigate an officer-involved shooting involving the United States Marshals Service (USMS).

On Monday, June 16, 2025, members of the United States Marshals Service (USMS) were involved in an officer involved shooting incident while attempting to apprehend a wanted fugitive in Clovis, New Mexico.

The fugitive, identified as Eric Gallagher, 24, was wanted on an outstanding probation violation warrant. The USMS had identified 2213 Echols Avenue as a residence Gallagher frequented. As USMS personnel approached the residence and spoke with the occupants, Gallagher fled the scene on foot, initiating a foot pursuit through a nearby alleyway.

During the pursuit, USMS Marshals deployed their department-issued tasers attempting to stop Gallagher. At some point during the foot pursuit, Gallagher brandished a firearm. Two members of the USMS discharged their department issued firearms, striking Gallagher.

Emergency medical personnel responded to the scene, and Gallagher was transported to an area hospital where he succumbed to his injuries. No Marshals were injured during this incident.

The USMS members will not be identified by the New Mexico State Police. For information on their duty status or administrative actions taken, please contact the USMS.

New Mexico State Police Investigations Bureau agents are working to independently determine the series of events leading to the shooting, including collecting evidence and conducting interviews. Throughout the process, investigative findings will be shared with the district attorney for review.

The New Mexico State Police acts solely as a factfinder in officer involved shootings and does not determine whether an officer’s actions were justified. That decision rests with the district attorney’s office. This incident remains under investigation by the New Mexico State Police.
