MAGISTRATE Court Briefs:
A bench warrant is in effect for Jayston Ray Platero, 35, of Los Alamos for failure to appear July 20 in Los Alamos Magistrate Court.
Platero was charged June 12 with two counts of child abuse in addition to charges of driving under the influence and driving on a revoked or suspended license.
Los Alamos Police officers were dispatched to the customer service desk at Smith’s Marketplace in response to an intoxicated male accompanied by two children. Platero was eventually arrested at the Smith’s gas station where he allegedly told police he had consumed four miniature bottles of alcohol. A female passenger in his vehicle allegedly said he drank a dozen miniatures.
Based on his Platero’s performance of a series of standard field sobriety tests Platero was arrested for driving under the influence of alcohol or drugs. Two later breath tests each yielded results of .15 breath alcohol concentration. He was free on conditions of release pending the July 20 hearing.
In other Court news, Wayne Hebert, 28, of Los Alamos received a suspended sentence of 364 days and was placed on unsupervised probation for 364 days after being found guilty of aggravated battery. He also was ordered to attend management classes and pay restitution of $400 to the victim. Los Alamos Police Cpl. Adam Jung arrested Hebert April 7 after he was called to a home and found the victim with two visible bumps on her head. The victim told Jung she had been struck by Hebert.
