RFP NAME:  White Rock Water Resource Recovery Facility Equipment

This project is wholly or partially funded with United States Environmental Protection Agency funds, and therefore must comply with all federal cross cutter requirements.  Neither the United States nor its department’s agencies or employees is or will be party to this invitation for bids or any resulting contract. This procurement will be subject to regulations contained in Uniform Administrative Requirements, Cost Principles and Audit Requirements, 2 CFR Parts 200 and 1500 and the Davis Bacon Act requirements.

All qualified applicants will receive consideration for employment without regard to race, color, religion, sex or national origin.  The contractor will not discriminate against any employee or applicant for employment because of race, color, religion, sex, sexual orientation, gender identity, or national origin. To ensure that Disadvantaged Business Enterprises (DBEs) have the opportunity to compete for procurements funded by EPA financial assistance, all Bidders shall make the six good faith efforts as outlined by EPA at https://www.epa.gov/sites/production/files/2013-09/documents/six_good_faith_efforts.pdf. The Bidder must make a good faith effort to solicit and hire Disadvantaged Business to meet the goals outlined in EPA XP-215. A good faith effort requires that the Contractor: 1) Complete the affirmative steps outlined in XP-215, 2) Submit XP-215 with the bid proposal, 3) Submit with the bid proposal proof that affirmative steps have been taken and this should include copies of advertisements and letters of solicitation. A Proposal that omits XP-215 or does not support that a good faith effort was made will be considered non-responsive and the Bid Proposal rejected.

NOTICE OF OPPORTUNITY TO COMMENT
Camp May Water Pipeline Project

James Melonas, Forest Supervisor, of the Santa Fe National Forest (SFNF) is requesting comments on the Draft Environmental Assessment (DEA) for the Camp May Water Pipeline Project.

The Proposed Action includes the following elements: burial of approximately 4.3 miles (22,795 feet) of 12-inch-diameter water pipeline, 4-inch-diameter fiber optic conduit, and 6-inch-diameter electric conduit originating on Department of Energy National Nuclear Security Administration (DOE/NNSA) lands and traveling along Camp May Road to Pajarito Mountain Ski Area. The project would also include the development of a 250,000-gallon water tank located adjacent the existing Pajarito Water Tank #4 on DOE/NNSA lands as well as four booster pump stations at various locations along the proposed pipeline alignment. Specific components of the Proposed Action are described in greater detail in Chapter 2 of the DEA. The project would require approximately 20.3 acres of disturbance, with approximately 12.9 acres on National Forest System lands, 7.4 acres on DOE/NNSA lands, and 0.2 acres on private lands.
In order to comply with current federal directives and New Mexico public health orders to contain the spread of the COVID-19 coronavirus, the SFNF is hosting an ongoing virtual “public meeting” at https://arcg.is/0uKG4G. This interactive story map allows visitors to review project information and anticipated environmental effects, ask questions, and submit comments electronically. The entire DEA is available on the Forest Service project website https://www.fs.usda.gov/project/?project=53328. How to Comment and Timeframe
The Notice of Opportunity to Comment on the DEA is anticipated to be released on May 20, 2020 in the SFNF newspaper of record, the Albuquerque Journal. Written, facsimile, and electronic comments concerning this action will be accepted for 30 days following that date. The publication date of the Notice of Opportunity to Comment in the Albuquerque Journal is the exclusive means for calculating the length of the comment period. Those wishing to comment should not rely upon dates or timeframe information provided by any other source. Comments may be made on any component of the Proposed Action.

NOTICE OF SPECIAL MEETING OF THE BOARD OF DIRECTORS
OF THE MIRADOR PUBLIC IMPROVEMENT DISTRICT

NOTICE IS HEREBY GIVEN that a special meeting of the Board of Directors (the “Board”) of the Mirador Public Improvement District (the “District”) will be held in White Rock, New Mexico at the White Rock Branch Library on May 26, 2020 at 4:00 p.m. The meeting will be open to the public. An agenda for the meeting may be obtained 72 hours prior to the meeting from jjacobi@rodey.com. In the event the Governor’s Executive Order declaring a state of public health emergency is in effect on the special meeting date and the library is closed or unable to accommodate all attendees of the meeting, members of the public may attend and listen to the special meeting by telephone by using the following call-in number and passcode: Dial-in number: 1-888-809-5053 and Passcode: 505 768 7222.

At this meeting, the Board will determine, among other things, whether the District should acquire public infrastructure described in the general plan of the District (collectively, the “Series 2020 Project”). In making this determination, the Board will (i) consider the study of the feasibility and benefits of the public infrastructure improvement project, which includes the Series 2020 Project, prepared in accordance with the Public Improvement District Act, NMSA 1978, Sections 5-11-1 to -27 (2001, as amended through 2020) (the “Feasibility Study”) and (ii) hold a public hearing on (a) the Series 2020 Project and (b) the related Feasibility Study.

After the public hearing, the Board may choose to approve those matters and, if approved, the Board shall adopt a resolution approving, among other things, the Feasibility Study and the Series 2020 Project. The title (subject to amendment or substitution) of the resolution is:

INCORPORATED COUNTY OF LOS ALAMOS RESOLUTION NO. 20-04

A RESOLUTION AMENDING RESOLUTION NO. 19-08 (A RESOLUTION DESIGNATING THE LOCATION OF ELECTION DAY POLLING PLACES FOR ALL STATEWIDE AND SPECIAL ELECTIONS CONDUCTED IN 2020 AND 2021; AND ESTABLISHING THE COUNTY CANVASSING BOARD THROUGH THE END OF 2021) TO REDUCE THE NUMBER OF ELECTION DAY POLLING PLACES FOR THE JUNE 2, 2020 PRIMARY ELECTION

WHEREAS, on June 25, 2019, pursuant to the New Mexico Statutes Annotated 1978, Section 1-3-2 (2019), in Resolution 19-08, the Council of the Incorporated County of Los Alamos (“County Council”) designated the location of election day polling places in the County for conducting any statewide election conducted in calendar years 2020 and 2021; and

WHEREAS, due to the contagion of the SARS-CoV-2 virus and the very real potential for poll workers and voters to contract the COVID-19 disease through the in-person voting process, absentee ballot applications are being sent to all registered members of the three major political parties; and

WHEREAS, because all eligible voters are being encouraged to vote by mail and to reduce the number of needed poll workers for the June 2, 2020 Primary Election and Presidential Primary Election the number of election-day polling places should be reduced to the minimum required by law; and

WHEREAS, a significant reduction in in-person voting is projected due to the order entered on April 16, 2020 by the New Mexico Supreme Court in State of New Mexico, ex. rel. et. al. v. Maggie Toulouse Oliver, Secretary of State et. al., S-1-SC-38228 requiring the mailing of an absentee ballot application for the June 2, 2020 primary election to every major party registered voter In New Mexico, and

WHEREAS, this April 16, 2020 New Mexico Supreme Court expressly found that in-person voting poses a substantial health risk to New Mexicans, and further ordered that the conduct of in-person voting comply with all applicable Executive Orders and Public Health Orders issued by the Governor of New Mexico and Secretary of the New Mexico Department of Public Health, and

WHEREAS, a reduction in the number of in-person polling locations is necessary to meet the requirements of Executive Orders and Public Health Orders issued by the Governor of New Mexico and Secretary of the New Mexico Department of Public Health to minimize the threat of the SARS-CoV-2 virus, and to

WHEREAS, pursuant to:
Section 1-3-7(A): “No less than one polling place shall be provided for each precinct . . . .”;
Section 1-3-4(B)(3): “each voter convenience center shall be a consolidated precinct composed of no more than ten precincts;”; and
Section 1-1-12(B): “. . . in a statewide election, references to “precincts” in the voting process shall be applicable to consolidated precincts.”;
Section 1-3-5(B): “. . . No precinct shall be created, divided, abolished or combined or the boundaries adjusted less than four months prior to a statewide election, except by order of the district court.”; and
Section 1-11-1: “The county clerk shall, at least twenty-one days prior to a statewide election, give notice of the election.”.

NOW, THEREFORE, BE IT RESOLVED that the Council of the Incorporated County of Los Alamos amends Resolution No. 19-08 only for purposes of the June 2, 2020 Primary Election and Presidential Primary Election, and designates the following election day polling locations for the 2020 Primary Election and Presidential Primary Election, as follows:
a. Precincts 1 through 7 are consolidated with a Voter Convenience Center located at the White Rock Town Hall Conference Training Room, 139 Longview Drive, White Rock, New Mexico.

b. Precincts 8 through 16 are consolidated with a Voter Convenience Center located at the Los Alamos County Golf Course Community Room, 244 Diamond Drive, Los Alamos, New Mexico.

c. Precincts 17 through 21 are consolidated with a Voter Convenience Center located at the Los Alamos County Municipal Building Council Chambers, 1000 Central Avenue, Room 100, Los Alamos, New Mexico.

d For voters who timely submitted an Absentee Voter Application, Mail-In Ballots will be mailed to those voters twenty-eight (28) days before the election.

e. It is further noted that any voter from any precinct in the County can cast a vote at any of these Voter Convenience Centers regardless of the precinct in which they live.

NOW, THEREFORE, BE IT FURTHER RESOLVED that following adoption of this Resolution by the Council of the Incorporated County of Los Alamos, the County Attorney is directed to seek approval of the District Court of the new consolidated precincts, adjusted consolidated precincts, or abolished precincts or consolidated precincts for purposes of the voting process in the 2020 Primary Election and Presidential Primary Election only; and

NOW THEREFORE, BE IT FURTHER RESOLVED that the County Clerk shall include the amended polling locations provided for in this Resolution in the Notice of Election that is posted no later than Tuesday, May 12, 2020; and

NOW THEREFORE, BE IT FURTHER RESOLVED that the County Clerk shall forward a copy of this Resolution to the Secretary of State and inform the Secretary of State when the District Court has approved the amended polling locations provided for in this Resolution; and

NOW, THEREFORE, BE IT FURTHER RESOLVED all remaining elements of Resolution 19-08 not in conflict with this Resolution remain in full force and effect.
