DA Marco Serna Forms Shooter Review Panel

SANTA FE – First Judicial District Attorney Marco P. Serna has formed the first officer involved shooting review panel in the First Judicial District. The decedent from the April 29 shooting is Andrew Lucero and the officer involved is Leonard Guzman.

The panel will include five district attorneys from around the state and the Administrative Office of the District Attorneys (AODA) will coordinate logistics, obtain and distribute evidence to the members for review.

“I promised the people of Northern New Mexico that I would eliminate the previous practice of using an investigative grand jury to determine if police shootings are justified, and today I am announcing that I have formed the first officer involved shooting review panel in the First Judicial District,” Serna said. “This new practice will protect our police officers who put their lives on the line every day to protect us, and it will ensure fairness and accuracy as police shootings are reviewed.”

The officer involved shooting review panel will consist of five District Attorneys:

  • Raul Torrez, 2nd Judicial District;
  • Richard Flores, 4th Judicial District;
  • Donald Gallegos, 8th Judicial District;
  • Tim Rose, 10th Judicial District; and
  • Rick Tedrow, 11th Judicial District.

 

Upon completion of the review, the AODA will set a date for the committee to reconvene to discuss the facts and evidence surrounding the shooting. If the shooting is found to be unjustified, Serna said he will appoint a special prosecutor to take the case before a district judge to determine if there is enough evidence to proceed to trial.
