Man Arrested For Aggravated Assault At Restaurant

A White Rock man was charged with aggravated assault with intent to commit a felony and disorderly conduct Saturday evening after he became disgruntled with employees at Rigoberto’s Taco Shop and threatened to go to his vehicle and get his gun.

Lex Norman Deines, 48 had ordered food along with his family when he became upset with the cashier for refusing to change his order. Police were called after other patrons became uncomfortable with his foul language and the extent of the anger he displayed, particularly when he made reference to his gun.

Los Alamos Police Cpl. Jemuel Montoya and Cpl. Adam Jung responded to the scene. Montoya’s report states that he found Deines being argumentative with the workers behind the counter. When he stood next to Deines, Montoya said he could smell the strong odor of intoxicating liquor emitting from his person. He said Deines began to be aggressive with the workers so he drew closer to him at which point Deines said, “Oh, it’s come to this”.

Montoya asked Deines to step outside the restaurant to speak with him and asked him what the problem. Deines reportedly responded that his order was wrong and they wouldn’t change it. Montoya left Deines outside while he spoke to restaurant employees and patrons. The cashier and patrons told Montoya that Deines had threatened to exit the restaurant, go to his vehicle and return with his gun if he didn’t get what he wanted.  Deines was placed in handcuffs and transported to the Los Alamos Detention Center for booking.

A criminal complaint and statement of probable cause was filed Monday in Los Alamos Magistrate Court.
