Skylar B. SmithSkylar B. Smith, 25, arrested in Los Alamos in 2012 on 20 counts of automobile burglary and 16 counts of larceny, is scheduled for a probation violation hearing Thursday before First Judicial District Chief Judge Mary Marlowe Sommer.
Adult Parole and Probation officials have stated that Smith is “clearly not suitable for supervision”.
“He is so involved in criminal activity it almost appears as if he goes out of his way to get himself arrested on felony charges,” officials said following Smith’s latest arrest Oct. 30, 2017, in Prower County, Colo.
The Prower County Sheriff’s Department responded to a report of a possible stolen vehicle matching the description of a vehicle stolen in Kansas. When Smith was apprehended at a restaurant in connection with the vehicle theft, he had 4.9 grams of heroin in his possession as well as .40 caliber handgun with the serial number scratched off. He was charged with possession of heroin, theft of license plates, possession of a firearm by a convicted felon, possession of two or more financial transaction devices and possession of a defaced firearm.
Of the original 38 Los Alamos charges from 2012, only two of them made it to the 2014 global plea agreement – two auto burglary counts. Other counts in the plea agreement were from Santa Fe County and included aggravated burglary, automobile theft and automobile burglary. Smith was given a suspended sentence of nine years, placed on five years of supervised probation and ordered to pay restitution of $11,532 to the two Los Alamos victims.
In September 2016, Smith admitted to violating the terms of probation under the 2014 plea agreement after racking up new charges of aggravated assault, battery and domestic violence. He was ordered to serve 10 months in incarceration with “good time” allowed and complete the remaining four years and five months of supervised probation.
Deputy District Attorney has filed a petition to revoke Smith’s probation and asked for him to be incarcerated for the remainder of his sentence.
